Normally a calculation must be made which should have available between 9% and 10% over and above the sale price to cover the Notary, Lawyer, Land Registry and finally the Property Transfer Tax, which is generally 6.5% of the sale price.
Logically, you should consult an advisor or a lawyer for advice, as all charges and debts must be eliminated in order to buy a property.
Firstly, you should contact the creditor holder of the debt or charge and ask if it is financially discharged.
If this is not the case, it should be canceled in advance or as part of the purchase price.
On the other hand, once the debt has been canceled, it must be formally canceled before the notary so that the property – for public domain purposes – appears free of any encumbrances.
Alternatively, all costs and debts can also be deducted from the sale price so that the buyer is responsible for the cancellation of debts.
You have the right to claim the rent from your tenant and to bring an eviction action. There is no specific number of months that determines the number of months for eviction action, but from the moment rent or similar amounts (water and electricity, among others) are owed, the landlord would already have the right to make a claim.
It should be taken into account that it is necessary for the initial claim to be made by a lawyer in order to be able to continue with the eviction, since if there is no letter of preliminary injunction, the tenant could clear the outstanding with the court and continue in his property.
Yes, it is usual, depending on the conditions of each party and local customs. Usually it is obligatory, by means of a private purchase contract, to sign an agreement that obliges both parties to go to the Notary to pay the rest of the price within a certain period of time (usually 30 to 90 days).
